These Terms of Use govern your use of Loyalti ("the platform"), operated by Business Direct Media ("Loyalti", "we", "our", or "us"), accessible at loyalti.co.za. By registering for or using Loyalti, you agree to be bound by these terms. If you do not agree, please do not use the platform.

1. Who can use Loyalti

Loyalti is available to two types of users:

You must be 18 years or older to register an account on Loyalti. By using the platform you confirm that you are 18 or over.

When you register a business on Loyalti, you agree to:

New business accounts are subject to review and activation by the Loyalti team before customers can scan your QR code. We reserve the right to decline or deactivate any account that we deem unsuitable or in breach of these terms.

4. Voucher codes and stamps

Loyalti uses a single-use voucher code system to control stamp issuance. Each voucher code is issued by the business owner and can only be redeemed once. Loyalti does not guarantee the value or availability of any reward offered by a business owner — rewards are set and fulfilled entirely by the business.

Stamps earned on the Free plan are tracked by browser session cookie. Stamps earned while logged in to a registered customer account are linked to that account and are more reliably preserved across devices.

5. Subscription plans and billing

Loyalti offers three plans: Free, Growth (R149/month), and Pro (R349/month). The Free plan is available indefinitely at no cost.

Growth plan subscriptions are processed via PayFast, a third-party payment gateway. By subscribing, you authorise PayFast to charge your payment method on a monthly recurring basis. Loyalti does not store your card details.

Pro plan billing is handled directly by Loyalti on a monthly invoice basis.

Refunds are not provided for partial billing periods. You may cancel at any time and your plan will remain active until the end of the current period.

Loyalti reserves the right to change pricing with 30 days notice to affected subscribers.

The complaint routing system is designed to give customers a private channel to provide feedback to business owners. Complaints submitted through Loyalti are shared with the relevant business owner and may include the customer's name and contact details if provided. Loyalti does not moderate or adjudicate disputes between customers and businesses.

Loyalti redirects positive ratings to Google Reviews at the business owner's request. This is an automated redirect and does not constitute an endorsement by Loyalti.

8. Intellectual property

All content, design, code, and branding on the Loyalti platform is the intellectual property of Business Direct Media. You may not reproduce, distribute, or commercially exploit any part of the platform without prior written consent.

9. Limitation of liability

Loyalti is provided "as is". We do not guarantee uninterrupted availability of the platform and are not liable for any loss of stamps, rewards, or business data arising from technical issues, server outages, or load shedding.

We are not responsible for the quality, fulfilment, or availability of rewards offered by business owners. Any dispute relating to a reward should be raised directly with the relevant business.

Our total liability to you in any circumstance shall not exceed the amount you have paid to Loyalti in the 3 months prior to the claim.

10. Termination

We reserve the right to suspend or terminate any account that breaches these terms, engages in fraudulent activity, or is otherwise harmful to the platform or its users. You may request deletion of your account at any time by emailing hello@loyalti.co.za.

11. Changes to these terms

We may update these Terms of Use from time to time. Significant changes will be communicated via email to registered users. Continued use of the platform after changes constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.
